Deletion of Genetically Modified Food Labels Impairs Consumers' Right to Know

Recently, Dai Jingrui, an academician of the Chinese Academy of Engineering and a corn breeder, estimated roughly: “I think 80% of the Chinese people and over 90% of today's Chinese have eaten genetically modified foods.”

According to Article 28 of the "Regulations on the Administration of the Safety of Agricultural Genetically Modified Organisms", agricultural genetically modified organisms listed in the list of agricultural genetically modified organisms within the territory of China shall be clearly identified. Food safety law also has relevant regulations. The "Regulations on the Implementation of the Food Safety Law," which was publicly solicited in October last year, also requires that foods directly produced using raw materials for genetically modified organisms should be marked in accordance with relevant regulations.

Obviously, this kind of institutional arrangement is more reasonable. Only if genetically modified foods are marked clearly can consumers' right to know and choice be guaranteed. Moreover, this is also in line with the provisions of Articles 8 and 9 of the Consumer Protection Law of the People's Republic of China, that is, consumers have the right to know the real situation of the goods and their right to choose independently. In addition, other countries have similar provisions, such as the United States Congress passed the GM Food Compulsory Labeling Act last year.

Although China’s laws and regulations have given consumers the right to choose genetically modified foods, in reality, consumers’ right to know and choice are not respected and guaranteed in many cases. For example, when consumers go to restaurants and whether the food provided by the restaurant uses GM crops, consumers have almost never been notified. For another example, many publicly sold food products contain genetically modified ingredients, and consumers are not aware of it.

A few years ago, some experts said that "most people in China have already eaten genetically modified foods." This time, Dai Jingrui estimated that "more than 80% of people in China have eaten genetically modified foods." Of course, these judgments still need to be confirmed by specific investigation results because, for many people, they have unknowingly eaten genetically modified foods in restaurants or other channels.

In other words, despite the "Regulations on the Safety Management of Agricultural Genetically Modified Organisms" that was implemented in May 2001, which requires the marked labeling of genetically modified foods, many foods have not been labelled as required for more than a decade. Although the Food Safety Law revised in 2015 stipulates that the production and operation of genetically modified foods should be clearly marked according to regulations, severe punishment will be imposed, but some foods are still not marked today.

In the author's opinion, the "transgenic labeling problem" is the reflection of the lack of protection of consumer rights. This shows that over the past years, the implementation of relevant laws and regulations has not been very satisfactory. Consumers are passively consuming genetically modified foods. On the surface, this seems to prove that GM foods are safe and conducive to the promotion of genetically modified foods, but in reality they may not necessarily be recognized by consumers. Because, whether consumers accept or accept genetically modified foods depends not only on scientific research results recognized by the world, but also on whether their right to know and choice have been properly respected.
